2011:COMPULSORILY RENEWABLE

Surprisingly, the Government extended to the 1st of January, 2011 the deadline for municipalities to introduce in their building regulations the obligation to use renewable energy sources for new buildings.
The extension is part of the Amendment to Decree nr 194/2009 (the so called “thousand fold extended decree”), approved by the Italian Senate on February 11th and under Parliament’s examination these days.
In details it says that, in order to get building permission, for each new-build house it must be guaranteed not less than 1 kW green energy production (in accordance with technical realizability of intervention).
For industrial buildings bigger than 100 square meters, instead, minimum green energy production will be 5 kW.
Notwithstanding deadline extension by the Government, many Italian Regions didn’t wait the 1st of January 2010 to introduce regulations implying the presence of “green” plants in buildings.
 The Puglia Region, for example, with Regional Law nr 3 of 09/03/2009, says the same things as the government law but brings forward effective date to 01/01/2009.
Other Regions (Umbria, Lombardia, Emilia Romagna, Campania, Trento Province and, even earlier, Lazio, Liguria and Piemonte) passed laws that oblige thermal solar panels or other plants installation on on new-built building and, in Umbria and Lazio, also in case of renovation.
